Abstract

In Perú arbitration in all areas of public contracting is a compulsory non-in equity but in law arbitration. Even more, Supreme Decree No. 184-2008-EF, Regulation to the Public Contracting Law, establishes that if in a given contract an arbitration clause is not part of it, the law will considerer included on it a model clause set by the law itself. However, the same Law allows that the arbitration court could be integrated by non-lawyers arbitrators (a common rule in an in law arbitration)
