RESUMEN: Se destaca la importancia de una Constitución; se considera fuera del texto mismo de la Constitución boliviana a su Preámbulo; óbices al ejercicio de los derechos fundamentales que ella tiene; interrogante sobre si Bolivia es un Estado o una República; Interpretación democrática del resultado de las pasadas elecciones judiciales.

ABSTRACT:The importance of a constitution, is considered beyond the text of the Bolivian Constitution to its Preamble; óbices the exercise of fundamental rights that she has; question of whether Bolivia is a state or a republic.

LA ORDEN EUROPEA DE PROTECCIÓN

La Unión Europea ha aprobado recientemente la Directiva que regula la Orden Europea de Protección. Se trata de un instrumento que tiene por objetivo extender la efectividad de una medida de protección adoptada en un Estado miembro al resto de Estados miembros. La principal dificultad que se observa en su aplicación es la heterogeneidad de la regulación de la violencia de género en los distintos Estados miembros.

The European Union has recently approved the Directive of the European Protection Order. It is an instrument which aim is to ensure that any protection provided by the law to a victim in one Member State continues if he or she moves to another Member State.The main difficulty is seen in its application is the heterogeneity of the regulation of gender violence in the various Member States.

NUEVAS POSIBILIDADES DE MOVILIDAD SOCIETARIA INTERNACIONAL EN ESPAÑA.

El presente trabajo analiza la viabilidad que el recientemente modificado régimen legal del traslado internacional del domicilio social de las sociedades mercantiles españolas, puede tener, a la hora de garantizar la movilidad societaria internacional. Con este fin, se analiza no sólo el procedimiento de salida, sino también el procedimiento previsto para que sociedades extranjeras puedan trasladarse definitivamente a España.

This paper analyzes the feasibility of the newly amended Spanish legal regulation of the international transfer of registered office of Spain's business companies, in order to ensure international corporate mobility for them. To this end, we analyze not only the emigration procedure, but also the procedure provided for foreign companies to move permanently to Spain.

LA CODIFICACIÓN DEL DERECHO PROCESAL CONSTITUCIONAL EN BOLIVIA

: El presente ensayo, pretende mostrar el incipiente desarrollo del Derecho Procesal Constitucional en nuestro país, y su actual configuración como rama especializada y autónoma del Derecho Público, a través de la inminente aprobación del Código de Procedimientos Constitucionales en la Asamblea Legislativa Plurinacional, anotando algunas sugerencias para su optimización normativa, y poniendo de relieve su necesaria incorporación al sistema de control de constitucionalidad vigente en el Estado Plurinacional de Bolivia.

The present test, it tries to show the incipient development of the Constitutional Procedural law in our country, and his current configuration as specialized and autonomous branch of the Public law, across the imminentapproval ofthe Code of Constitutional Procedures in the Legislative Assembly Plurinational, annotating some suggestions for his normative optimization, and emphasizing his necessary incorporation to the system of control of in force constitutionality in the State Plurinational of Bolivia.
